Notifying absentees of the resolutions: the step almost everyone skips
The meeting is over, the minutes are signed… and the step half of Spain skips is still pending: notifying those who did not attend.
Why it matters
- The absentees' time limits for challenging a resolution start when they receive the minutes.
- On three-fifths resolutions (pool, holiday lets, new services), the vote of notified absentees who do not object within 30 days counts as being in favour — without valid notification, that count does not exist.
How to notify validly
At the address each owner has designated (or, failing that, at their flat in the building), and if that is impossible, via the community's noticeboard with a dated record (it takes effect after three days). Email is valid if the owner accepted it as a channel — good practice: collect that acceptance in writing from everyone, once.
The system that does not fail
- Minutes closed and signed within days, not months.
- Sent to everyone (including those present: transparency) through the accepted channel.
- A record of the sending date.
- A copy on the board for the impossible cases.
With the minutes permanently accessible to everyone, moreover, notification stops being an annual problem: anybody can look up any resolution whenever they want.
